LUSTRATION IN POST-SOCIALIST COUNTRIES AS A KEY ELEMENT OF TRANSITIONAL JUSTICE AND EUROPEAN INTEGRATION

The article examines the institutional framework for lustration policies in post-socialist countries of Central and Eastern Europe. Lustration is considered as a key element of transitional justice and European integration, as well as a prerequisite for the formation of a democratic paradigm of public administration. It analyzes international acts of the United Nations and the Parliamentary Assembly of the Council of Europe that regulate the implementation of transitional justice in the process of post-conflict settlement. Attention is paid to the activities of the European Court of Human Rights in matters of compliance with fundamental human rights and freedoms and the conformity of national legislation and administrative measures on lustration with the principles of the rule of law. The international policy of post-socialist countries’ governments on unification for the purpose of European integration, which was implemented in the first half of the 1990s, is studied, and the place of lustration in this policy is clarified. The positive experience of lustration is highlighted using the example of individual countries in Central and Eastern Europe that were part of the former socialist bloc – the Czech Republic, Germany (in particular, the former German Democratic Republic), Lithuania, and Poland. The national legislation of these countries is analyzed, and the activities of national institutions and their results in terms of purging the authorities as an element of transitional justice are examined. Based on the results of the study, it was concluded that the implementation of the lustration policy in the 1990s and 2000s was not uniform and that it was partially regulated by law in the post-socialist countries of Central and Eastern Europe. The importance of implementing the policy of lustration in the process of European integration of post-socialist countries has been proven. The key role of lustration in the implementation of transitional justice and in the democratization of post-conflict societies of the former socialist bloc countries has been determined.
