WITHDRAWAL OF THE RIGHT TO DRIVE VEHICLES AS AN ADDITIONAL TYPE OF PUNISHMENT FOR VIOLATION OF ROAD SAFETY RULES OR OPERATION OF VEHICLES BY PERSONS WHO DRIVE VEHICLES

The article is devoted to the study of the deprivation of the right to drive vehicles as an additional type of punishment for violating the rules of road traffic safety or the operation of vehicles by persons who drive vehicles. Based on the analysis of court verdicts in criminal cases under Art. 286 of the Criminal Code of Ukraine defines and characterizes the educational effect of an additional type of punishment in the form of deprivation of the right to drive vehicles on a person guilty of violating the rules of road traffic safety or vehicle operation. The discrepancy existing in the current criminal legislation of Ukraine between the term of deprivation of the right to drive vehicles and the socially dangerous consequences that have occurred, as well as the legislative possibility of not applying additional punishment for more serious consequences that have occurred. In particular, a violation of the rules of road traffic safety or the operation of a vehicle by a person driving a vehicle, if it caused the death of the victim or caused serious bodily injury (Part 2 of Article 286 of the Criminal Code of Ukraine) does not require the imposition of an additional type of punishment in the form of deprivation of rights to drive vehicles, in contrast to a similar socially dangerous act, which caused the victim only moderate physical injury (Part 1 of Article 286 of the Criminal Code of Ukraine). Also, regardless of the resulting consequences: moderate bodily injury (Part 1), serious bodily injury or death (Part 2) or the death of several persons (Part 3), deprivation of the right to drive vehicles as an additional type of punishment may be imposed only for a period of up to three years. All this contradicts the principle of justice and proportionality of the imposed punishment to the socially dangerous consequences that have occurred. Taking into account the considerable influence of the educational nature of the deprivation of the right to drive vehicles on the guilty person, the improvement of the specified additional type of punishment is relevant and necessary to ensure the safety of traffic and operation of transport.
