ENSURING THE SAFETY OF SEARCH PARTICIPANTS IN CONDITIONS OF INCREASED DANGER: LEGAL AND TACTICAL DIMENSIONS

The article provides a comprehensive scientific analysis of the legal foundations and tactical recommendations for ensuring the safety of participants in searches conducted under conditions of increased danger. The relevance of the research is determined by the significant transformation of the security environment in Ukraine caused by the full-scale armed aggression of the Russian Federation, which has fundamentally changed the conditions for conducting investigative (search) actions. The study examines the current criminal procedural legislation of Ukraine, in particular Articles 234–236 of the Criminal Procedure Code, and identifies significant gaps in the legal regulation of safety measures during searches. The concept of conditions of increased danger is defined and the relevant objective and subjective factors are classified, including the presence of weapons or explosive devices, the risk of armed resistance, and mine contamination of de-occupied territories. A three-stage safety model (preparatory, working, final stages) and a classification of searches by danger level (standard, increased, critical) are proposed, with differentiated tactical algorithms for each level. The specifics of conducting searches in de-occupied territories with mine threats are examined, and the mandatory involvement of explosive ordnance disposal specialists is substantiated. The application of modern technical means – unmanned aerial vehicles, robotic complexes, and portable X-ray scanners – is considered. Foreign experience of the United States, United Kingdom, and Poland is analyzed. Proposals are substantiated regarding amendments to Article 234 of the Criminal Procedure Code of Ukraine, the development of interdepartmental protocols, broader use of video recording instead of civilian witnesses under dangerous conditions, and introduction of mandatory specialized training for investigators and operational officers.
