ADMINISTRATIVE LIABILITY OF LEGAL ENTITIES FOR VIOLATIONS IN THE FIELD OF MILITARY RECORDING OF EMPLOYEES

Abstract

The system of military registration of employees is the most important element of the state’s defense policy, which ensures the timely mobilization of labor resources in wartime conditions. Legal regulation of this area is based on the principles of the universality of military duty and the obligation to maintain military records by all business entities, regardless of organizational and legal form and form of ownership.Administrative liability of legal entities for violations of the requirements of military registration of employees is a specific legal institution that is at the junction of administrative law and military legislation. This institution is characterized by special social significance, as it is aimed at ensuring national security and the state’s readiness to reflect external threats.The main types of administrative offenses in the studied area are untimely submission of information about employees who are on military registration, ignorance of military registration documents, failure to comply with the order of booking military employees, as well as obstruction of military medical examinations and military training.Each of the above violations entails specific legal consequences, the gradation of which depends on the degree of public danger of the committed act.The system of administrative sanctions applied to legal entities for violations in the field of military registration includes a warning and an administrative fine. The amounts of penalties are differentiated depending on the nature of the violation and vary from minimal amounts for minor procedural violations to significant amounts for systemic violations of military registration requirements. A feature of these sanctions is their preventive nature, aimed at preventing repeated violations.The procedure for bringing legal entities to administrative responsibility for violations in the field of military accounting of employees is characterized by the participation of specialized subjects of administrative jurisdiction – military commissariats and their officials. These bodies have exclusive competence in identifying, recording and investigating administrative offenses in the area under study, which is due to the specifics of military accounting activities.The current state of legal regulation of administrative liability of legal entities for violations in the field of military accounting of employees requires further improvement in the direction of strengthening the preventive impact of administrative sanctions, optimizing administrative proceedings procedures and increasing the efficiency of interaction between military commissariats and business entities. Promising directions for the development of this legal institution are the digitalization of military accounting processes and the implementation of automated systems for monitoring compliance with the requirements of military accounting legislation.
