ON THE NEED TO OBSERVE THE PRINCIPLE OF THE RULE OF LAW IN THE ACTIVITIES OF OFFICIALS OF THE PENSION FUND OF UKRAINE

Abstract

The article analyzes the practical activities of officials and officials of the territorial units of the Pension Fund of Ukraine on pension and other social security issues for the citizens of our country, identifies problematic points of a regulatory and legal nature that arise in connection with this, and also develops scientifically based measures. aimed at their elimination and improvement of the legal mechanism as a whole, which regulates the specified branch of social legal relations. In particular, it was established that, contrary to the requirements of the principle of the rule of law, which is enshrined at the constitutional level of Ukraine, some officials and officials of the relevant bodies of the Pension Fund of Ukraine unjustifiably and baselessly rely on persons who apply to them for pension or other social security issues to present certificates and documents that are not provided for in the current legislation of Ukraine on the specified issues. Such an approach not only creates artificial conflict situations with the applicants, but also forms the so-called "corruption complex", thanks to which officials and officials of the specified state body try to obtain the appropriate undue benefit (material, monetary, in the form of services, etc.). In order to eliminate the determinants that contribute to the commission of the specified offenses, as well as to bring the activities of the above-mentioned subjects of the territorial bodies of the Pension Fund of Ukraine to the requirements of the principles of supremacy and legality, this scientific article has developed a number of author's scientifically based measures, both normative and legal, and doctrinal approaches, as well as practices of the European Court of Human Rights.
